Court of Appeal pardons Lawyer Afrifa…reduces 4 year ban to 18 months

The Court of Appeal has upheld an appeal by Kumasi-based legal luminary Kwasi Afrifa against the decision of the General Legal Council to suspend him for a period of four years.

The General Legal Council has since July 27, 2017  purportedly suspended lawyer Afrifa for alleged professional misconduct based two counts under Rule 5 (10) of the Legal Profession (Professional Conduct and Etiquette) Rules, 1969 L.I. 613.

Lawyer Afrifa consequently appealed against the entire decision as well as the four year order of the Disciplinary Committee of the Ghana Legal Council to ban him from practicing for four years.

The appeal is on the premises that the Committee erred in entertaining the complaints when same issue had been raised before a Kumasi High Court and dismissed culminating in an appeal by the complainants before the Court of Appeal in Kumasi which case is still pending at the time the GLC issued the banning order.

The Court of Appeal constituted by Victor Ofoe JA, Gertrude Torkonoo JA and Surubaareh JA on November 29, 2018 granted the appeal and reduced the ban to 18 months thus ending on January 27, 2019.

Lawyer Afrifa of O & A Legal Consult in Kumasi has since resumed practice accordingly.
